Terms and Conditions of the MaestroArt Online Shop

§ 1 General Provisions and Seller Details

These Terms and Conditions define the rules for using the Shop, the rights and obligations of the parties, and the procedures for purchase and complaints. The Customer accepts these terms at the time of placing an order.

§ 2 Prices and Payments

  1. All prices of products (Riso prints, acrylic paintings, and other artworks) in the Shop are stated in Euro (€).
  2. Prices do not include BTW (VAT).
  3. Available payment methods: iDeal and PayPal.
  4. Payments are processed by secure, third-party payment providers.

§ 3 Delivery

  1. Shipping is available within the Netherlands and the European Union (EU).
  2. The estimated delivery time is a maximum of 10 working days.
  3. Shipping is free of charge (delivery costs are included in the product price).
  4. The Seller ensures that all artworks (especially delicate prints and paintings) are securely packaged to prevent damage during transport.

§ 4 Returns (Right of Withdrawal) and Complaints

  1. Right of Return: Customers acting as Consumers have the right to withdraw from the sales agreement without giving a reason within 14 days of receiving the shipment.
  2. Return Conditions: The returned product must be in its original, undamaged condition (unused), in its original or equivalent secure packaging. The Customer bears the direct costs of returning the product.
  3. Complaint Procedure (Defects and Damages):
    • In case of a product defect or damage occurred during transport, the Customer is requested to immediately send a report to the e-mail address provided in § 1.
    • The report must include a description of the issue and clear photographs showing the defect or damage.
    • Based on the provided photographic documentation, the Seller will review the complaint (e.g., via refund or replacement), which avoids the need for the Customer to return the product at their own expense.
    • The Seller will respond to the complaint within 14 days of receipt.

§ 5 Copyright and Uniqueness of Artworks

  1. All paintings, graphics, and prints sold on mrmaestroart.com are protected by copyright. The purchase of a physical artwork does not transfer any rights to the Customer for reproduction, copying, or commercial use of the image.
  2. Due to the nature of artistic techniques (e.g., Riso printing, hand painting), individual pieces may show minor variations (e.g., in color saturation or texture), which is a characteristic feature of such work and does not constitute a product defect.
  3. Images marked as “AI visualization” are for illustrative purposes only. The Customer should primarily refer to the technical and artistic description provided with the product.

§ 6 Final Provisions

  1. All agreements are governed by Dutch law.
  2. Any disputes shall first be resolved through amicable negotiation. The Customer has the right to use the European ODR (Online Dispute Resolution) platform.
  3. The Seller reserves the right to make changes to these Terms and Conditions. Changes take effect on the day they are published on the Shop’s website.
